Guardianship

While Guardianship may not be among the most talked about issues, it is important to take the time to consider the fact, that life is uncertain. Therefore, how will your loved ones be cared for if you were to pass away. One of the best ways to put those worries behind you, is to engage a reliable attorney to discuss your guardianship options.

What is a guardian ?

In the State of Alabama, legal guardianship is the result of a court hearing, conducted to appoint a caretaker for an underaged child, an adult, or disabled individual.  The caregiver in this situation is called the Guardian, and the person in their care is called the Ward. It is common to find a guardian after the child’s parents have died or are otherwise disabled and thus unable to care for them.

What are the duties and rights of a legal guardian ?

The Legal Guardian of a minor bears all the responsibilities of a normal parent. He/she must ensure that the child has a basic education and that all basic needs are met which includes medical care. This implies that, like parents, they must provide shelter and food until the child comes of age. The legal guardian also has the authority to make decisions on behalf of the minor concerned. He/she also has the right to all the child’s medical records as would the parents. The legal guardian acts “in lieu of” the parents.
